As those who follow such comings and goings closely may have noticed, a rather mysterious “GameStore” app seemingly made by Apple itself recently appeared in the App Store. It didn’t provide much in the way of functionality for its $0.99 price tag — displaying only a few in-app purchases that couldn’t actually be purchased — and now Apple has offered an explanation, of sorts, for the app’s existence. In a message to folks who bought the app, Apple said that the app (since pulled from the App Store) was “prematurely released,” and that it has refunded all purchases.

Well, it looks like Apple hasn’t completely left behind older iPhones and iPod touches stuck on iOS 3.1.3 just yet. After a few days of not being able to download or buy apps directly on the devices due to a recent App Store update that rendered such basic features unusable , Apple has now returned things back to working order. We’ve confirmed that ourselves on a first-generation iPod touch running 3.1.3, as have a number of iPhone and iPod touch users on the official Apple support forums.

While fragmentation is a rare(r) problem on iOS there’s still quite a few users rocking older versions on their devices. Unfortunately for them, ever since a recent update on the 16th they haven’t been able to download any new apps from the App Store straight to their devices. While users of older iPod Touches and iPhones stuck on 3.1.3 by choice or incompatibility with newer OSes can still update the apps they already have and transfer software from iTunes on a computer, they can’t buy or install new ones directly from the device.

The $2.99 app brings the isle of Lemuria directly to your iOS device of choice, letting you nurture these fledgling digital felines, in addition to unlocking a handful of them on a companion Xbox 360 title of the same name. It’s not the first time Redmond’s made its app wares available to Apple, as both OneNote and My Xbox Live have already hit earlier this month, but it certainly does signal a growing change for MS’ attitude towards its mobile competition
